These terms govern your use of our website. They are separate from our Terms & Conditions (Trade), which govern the electrical, air conditioning and solar work we carry out.

1. About these terms and your acceptance

These terms apply to your use of our website at eliteema.com.au (the “site” or “website”). By accessing or using the site, you accept these terms and agree to be bound by them. If you do not agree, please do not use the site.

These terms cover your use of the website only. They do not govern any work we carry out for you. Anything to do with bookings, quotes, site assessments and the actual electrical, air conditioning or solar work is governed by our Terms & Conditions (Trade).

We may update these terms from time to time. The version in force when you use the site is the version that applies. Please see section 14 for how changes work.

2. About us

The site is operated by Elite Electrical Maintenance and Airconditioning Pty Ltd (ACN 683 120 425, ABN 67 683 120 425). In these terms, “we”, “us” and “our” mean Elite Electrical Maintenance and Airconditioning Pty Ltd, and “you” means the person using the site.

We are a licensed and insured Brisbane electrical, air conditioning and solar business. Our credentials are:

• public liability insurance with $20 million cover

3. Using our website

Our website is an information site. It tells you about who we are, the services we offer, our compliance and safety information, customer reviews, and any current offers. It also lets you send us an enquiry through our quote and contact form.

You may view and use the site for your own genuine, lawful enquiry, whether personal or for your business. You must use the site only in a way that is honest and lawful and that does not interfere with anyone else’s use of it.

We may change, update, add to or remove any part of the site, including its content, features and the quote and contact form, at any time and without notice. We may also stop offering the site, in whole or in part. We are not obliged to keep any particular content or feature available.

We grant you a limited, revocable, personal, non-commercial licence to view and use the site and its content for your own genuine enquiry, as set out in these terms. We may withdraw this licence at any time.

Except as that licence allows, or as permitted by law, you must not copy, reproduce, republish, upload, post, distribute, modify or otherwise use any of our content or branding without our prior written permission.

Our business name and logo are our trade marks. You must not use them without our prior written permission.

6. Information on this website is general only

The service information, safety and compliance information, and any pricing shown on the site are general in nature and current at the time of writing. They are provided to give you a broad understanding of what we do.

This information:

• is general only and is not advice for your particular situation
• is not an offer capable of acceptance, and does not form a contract
• may change without notice and may not always be complete or up to date

Any work we carry out is subject to a site assessment and a written Quote, and is governed by our Terms & Conditions (Trade). Nothing on the site commits us to carry out work at a particular price or on particular terms until a written Quote is agreed.

Our compliance and safety content is general information about electrical and related matters. It is not legal advice and is not a substitute for advice from a licensed electrician or other qualified professional about your specific circumstances.

7. Promotions, offers and pricing shown on the site

From time to time we advertise offers and prices on the site, for example “$89 off”, “$350 off” or a reduced or waived call-out fee. Any advertised offer or price:

• is subject to availability and to any eligibility conditions we set
• is subject to a site assessment and a written Quote
• may change or be withdrawn at any time without notice
• cannot be combined with any other offer unless we say so

Advertised offers and prices are general information, not an offer capable of acceptance. The work itself, and any final pricing, is governed by our Terms & Conditions (Trade).

8. Enquiries and information you submit

When you send us an enquiry through the quote and contact form, you must give us accurate, current and complete information. You confirm that you are entitled to provide the information you give us, and that you are not impersonating anyone else.

We rely on the information you submit. If it is inaccurate or incomplete, we may not be able to respond properly to your enquiry.

We handle any personal information you give us in line with our Privacy Policy.

9. Third-party links and services

The site may contain links to third-party websites, and may reference third-party providers, including the finance providers Brighte and Zip Pay. We provide these links and references for your convenience and information only.

We do not control these third parties and are not responsible for their websites, content, products, services or terms. A link or reference does not mean we endorse them.

Any dealings you have with a third party, including any finance provider, are between you and that third party. They are at your own risk and on that third party’s terms. You should read their terms and check their products are right for you before you proceed.

10. Availability of the website

We try to keep the site available, accurate and up to date, but we do not promise that it will be. We do not guarantee that the site will be uninterrupted, timely, secure or free of errors, viruses or other harmful components.

We are not responsible for matters outside our reasonable control that affect the site, including faults in your device or internet connection, or failures of third-party hosting, networks or services.

Where our liability cannot be excluded by law but can be limited, our liability is limited to the maximum extent the law allows.

12. Your rights under the Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.

If we are liable to you for a failure to comply with a consumer guarantee that cannot be excluded, and the relevant goods or services are not of a kind ordinarily acquired for personal, domestic or household use or consumption, our liability is limited, to the extent the law allows, to:

• in the case of services, re-supplying the relevant services, or paying the cost of having them re-supplied
• in the case of goods, replacing the goods, supplying equivalent goods, repairing the goods, or paying the cost of any of these

13. Privacy

We respect your privacy. How we collect, use, store and disclose personal information, including any information you submit through the quote and contact form, is set out in our Privacy Policy. By using the site, you acknowledge our Privacy Policy.

14. Changes to these terms

We may update these terms from time to time, for example to reflect changes to the site, to our business or to the law. The current version is the one published on the site, marked with the “Last updated” date at the top of this page.

The terms in force when you use the site are the terms that apply to that use. We encourage you to review this page from time to time. If you continue to use the site after we publish updated terms, you accept the updated terms.

15. Governing law and how to contact us

These terms are governed by the laws of Queensland, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Queensland and the courts that hear appeals from them.
