Terms & Conditions (Trade)
Elite Electrical Maintenance and Airconditioning Pty Ltd
Last updated: 29 September 2026
This page sets out the terms on which Elite Electrical Maintenance and Airconditioning Pty Ltd supplies electrical, air conditioning and solar work.
1. Who these terms cover and how you accept them
These terms apply to all work we carry out for you, including electrical, air conditioning and refrigeration, and solar work, and any related goods we supply. In these terms “we”, “us” and “our” mean Elite Electrical Maintenance and Airconditioning Pty Ltd (ACN 683 120 425, ABN 67 683 120 425), and “you” and “the customer” mean the person or business we are doing the work for.
You accept these terms in any of the following ways:
- by accepting a Quote in writing, by email or by SMS;
- by accepting a Quote verbally on site;
- by allowing us to begin work; or
- by otherwise engaging us to carry out work.
Once you have done any of these things, these terms form the contract between you and us for that work. If you are accepting on behalf of a business or another person, you confirm you are authorised to do so.
2. Definitions
In these terms:
- “ACL” means the Australian Consumer Law set out in Schedule 2 to the Competition and Consumer Act 2010 (Cth).
- “Deposit” means the 10% booking deposit described in section 4.
- “Goods” or “materials” means any products, equipment, parts or materials we supply to you.
- “Quote” means a written quotation we issue for work, including the scope and the flat-fee price.
- “Variation” means any work outside the scope of the original Quote, as described in section 6.
- “workmanship warranty” means the Lifetime Workmanship Warranty described in section 7.
3. Quotes and flat-fee pricing (30-day validity)
We provide written, flat-fee Quotes. The price on your Quote is the price you pay, subject only to approved Variations (section 6) and the unforeseen-conditions carve-out below. This is what we mean by Flat-Fee Pricing, No Hidden Fees: the number on the Quote is the number on the invoice. There are no surprise charges.
A Quote is valid for 30 days from its date of issue, unless we state a different period in writing. After that, we may need to re-quote, as material and product prices can change.
We may withdraw or cancel a Quote at any time before you accept it.
Call-out fees
A call-out fee may apply for us to attend, assess the job and provide a written Quote. Whether a call-out fee applies, and how much it is, depends on the job, the time and your location, and we will always tell you when you book, before we attend. From time to time we may run a promotion that reduces or waives the call-out fee; any such promotion applies only as advertised at the time you book. Weekend, public holiday, after-hours and emergency attendance may be charged at higher rates than standard work. We will not carry out chargeable work without your approval.
We aim to be on time and to offer same-day service
We aim to arrive on time and to offer same-day service where possible. This is subject to availability, traffic and the demands of the day, and is not a contractual guarantee. We do not charge you, and we do not owe you a discount, if we are running late.
The flat-fee carve-out (unforeseen conditions)
A flat-fee price is based on the scope and the conditions we can see when we quote. The price may be adjusted if the scope of work changes (see Variations in section 6) or if unforeseen conditions arise during the job, for example hidden wiring faults, concealed damage, or site conditions that could not reasonably have been seen at the time of quoting. If that happens, we will talk to you about it and get your approval before doing the extra work or charging the extra cost.
4. Deposits and progress payments (10% deposit)
Deposit
For most booked work we take a 10% Deposit. The Deposit secures your booking and lets us allocate materials and trade resources to your job.
The Deposit is refundable in full if, at the time you cancel, no materials have been purchased and no trade resources have been allocated to your job. Once materials have been purchased or trade resources have been allocated, the Deposit is refundable to the extent it exceeds the costs we have actually incurred, and we will refund any balance to you. We will, on request, give you a reasonable account of those costs. In other words, you only ever lose the part of the Deposit that matches what we have genuinely spent on your job.
Progress payments
Multi-day jobs are done on milestone-based progress payments. We set out the milestones and the amount payable at each one before work begins. Each progress payment is paid in full before the next stage proceeds.
5. Final payment, payment methods, and late payment
Final payment, taken on site
For standard jobs, payment is taken on site, before our team leaves, on the day the work is completed. The remaining balance, which is the quoted price less the 10% Deposit and any progress payments already made, is paid in full on completion, before we leave. We do not leave a standard job with an unpaid invoice.
Payment methods
Payment is taken on site by EFTPOS, bank transfer (EFT) or cash, or by another method we agree with you in advance.
Late payment (invoiced or account work only)
The default for standard work is payment on site on completion, as set out above. This late-payment clause never applies to a standard consumer job that is paid on site. It applies only where we have agreed in writing to invoice an amount instead, for example certain commercial or account work. Where we agree to do that, the invoice is payable within 7 days of its date.
Any amount that remains unpaid after the agreed date may incur a late fee, and continued non-payment may lead us to suspend services and to take recovery action, in which case you agree to bear all reasonable costs of recovery, including reasonable debt-collection and legal costs.
6. Variations and unforeseen conditions
Any work outside the scope of the original Quote is treated as a Variation. We will discuss a Variation with you, and get your approval, before we carry it out. A Variation may change the price, the timeframe, or both, and we will tell you that when we discuss it.
Unforeseen conditions are dealt with the same way. If something we could not reasonably have seen at the time of quoting comes to light during the job (see section 3), we will raise it with you and get your approval before doing the extra work or applying any extra cost.
7. Our guarantees (Lifetime Workmanship Warranty, We Fix It or It’s Free*, 100% Satisfaction Guarantee)
These guarantees are in addition to your rights under the Australian Consumer Law (see section 9). They do not take away or reduce those rights. In particular, our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law, and the guarantees in this section sit on top of those rights. The mandatory wording of those consumer guarantees is set out in section 9, which forms part of this warranty.
Lifetime Workmanship Warranty
We warrant our own workmanship for as long as you own the property at which we did the work. This covers the quality of our installation and our labour.
It does not cover:
- the equipment or products themselves (these carry the manufacturer’s warranty, see section 8);
- fair wear and tear;
- misuse, neglect or damage;
- alterations, repairs or interference by anyone other than us; or
- events outside our control (see section 19).
The workmanship warranty applies to you as the owner of the property, and it ends if you sell or otherwise stop owning the property, except to the extent the ACL says otherwise.
We Fix It or It’s Free*
If we cannot provide a solution to your problem, or cannot get your system back up and running, you will not be charged for that work. Put simply, if we cannot fix it, you do not pay for our attempt to.
This promise is separate from our Lifetime Workmanship Warranty above. The warranty covers our workmanship if a repair we have completed later fails. This promise covers the different situation where we are not able to solve the problem in the first place.
This promise does not apply where:
- we provide a working solution, which is then charged as quoted;
- you decline the solution we recommend, or prevent us from carrying it out; or
- the issue is with equipment or parts you have asked us to supply, where the manufacturer’s warranty applies (see section 8).
100% Satisfaction Guarantee
If you are not happy with our workmanship, we will return and put it right. This guarantee is about making our workmanship right. It is not a no-questions cash refund on work that has been completed safely and to a compliant standard.
8. Manufacturer and equipment warranties
The goods and equipment we supply are covered by the manufacturer’s warranty for that product. These warranties are honoured and passed through to you, and we will help you make a claim where one applies.
Manufacturer warranties cover the product itself. They are separate from our workmanship warranty, which covers the quality of our installation and labour. Manufacturer warranties are subject to the manufacturer’s own terms and conditions.
Nothing in this section limits your rights under the Australian Consumer Law (see section 9).
9. Your rights under the Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the ACL that cannot lawfully be excluded.
For services, the position is this. You are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value, if the services have a major failure. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the services. If the failure does not amount to a major failure, you are entitled to have problems with the services rectified in a reasonable time, and if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.
For goods, the position is this. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Where the ACL applies and a guarantee is breached, and where the law allows us to limit our liability, we limit our liability, at our option, to:
- for services: resupplying the services, or paying the cost of resupplying them; and
- for goods: replacing the goods or supplying equivalent goods, repairing the goods, or paying the cost of replacing the goods or of having them repaired.
This section applies despite anything else in these terms.
10. Ownership of materials and PPSA
Retention of title
All materials and goods we supply remain our property until we have received payment in full for the relevant work and goods. Until then, you hold the goods as our bailee. Risk in the goods passes to you on delivery or installation, so you should make sure they are insured from that point.
Personal Property Securities Act
These terms create a security interest in the goods we supply, in our favour, to secure payment, for the purposes of the Personal Property Securities Act 2009 (Cth) (PPSA). You agree that we may register that security interest on the Personal Property Securities Register, and you agree to do anything reasonably necessary to help us register and maintain it.
To the extent the law allows, and except where the PPSA prohibits contracting out (including for collateral that is consumer property used predominantly for personal, domestic or household purposes), the parties agree to contract out of the provisions of the PPSA that may lawfully be excluded, including the relevant notice and enforcement provisions listed in section 115 of the PPSA, and the parties agree that section 275(1) of the PPSA does not apply and that neither party will disclose information of the kind mentioned in that section.
For clarity, we do not take, and these terms do not create, any charge, mortgage or caveat over your land or property. Our security interest is limited to the goods we supply.
11. Site access, safety and your responsibilities
So that we can do the work safely and on time, you agree to:
- give us safe, clear and timely access to the work area and to anything we need to reach to do the job;
- tell us about known hazards, and about the location of services such as wiring, pipes and solar cabling, before we start; and
- keep children and pets clear of the work area while we are on site.
We work hard to be respectful in your home or workplace, and we ask for the same in return. We may leave a job temporarily or indefinitely if there is dishonesty toward, or abuse of, our staff. Delays caused by you or by the site, including a lack of safe access, may incur additional charges, which we will discuss with you.
Older homes and hazardous materials
Some older Brisbane homes may contain asbestos or other hazardous materials, or unmarked services. This is common and not a cause for alarm, but it does need care. Please tell us about any known hazards and service locations before we start. Safe handling or removal of any hazardous material is your responsibility, or we can quote it as a Variation and arrange for it to be handled by a suitably qualified party.
12. Licensing, insurance and compliance certificates
We are Fully Licensed and Insured. Elite Electrical Maintenance and Airconditioning Pty Ltd holds:
- Electrical Contractor Licence 1503699;
- Clean Energy Council (CEC) accreditation S8372760 for solar;
- ARCtick licence L195110 for refrigerant handling; and
- public liability insurance with $20 million cover.
All of our work complies with the relevant Australian Standards and with Queensland electrical safety law. For hardwired electrical work that requires it, we are licensed to provide, and will provide, the relevant Certificate of Testing and Compliance.
13. Solar installations
Solar systems are installed by our Clean Energy Council accredited team (CEC accreditation S8372760), in line with the relevant standards and rules.
Where a point-of-sale discount for small-scale technology certificates (STCs) is applied to your price, that discount is conditional on you assigning to us the right to create those STCs. By accepting a Quote that includes this discount, you assign, or agree to assign, to us your right to create the STCs for your system, in return for the discount. You also agree to sign any assignment form that the Clean Energy Regulator or we reasonably require to give effect to that assignment, because the Regulator’s processes may require a separate signed assignment in addition to these terms. If the assignment cannot be completed, or the certificates are not validly created, for reasons attributable to you, we may recover from you the value of the discount we applied. The number and value of STCs depend on government settings at the time and can change.
The expected performance of a solar system depends on factors outside our control, such as weather, shading, your usage and the condition of the electricity network. We do not warrant a particular level of energy output or financial saving unless we have stated it in writing.
14. Air conditioning
Air conditioning and refrigeration work that involves refrigerant handling is carried out under our ARCtick licence L195110, in line with the relevant standards and rules.
For your air conditioning to keep working well, it needs reasonable care and routine servicing, such as cleaning filters and periodic checks. Our workmanship warranty (section 7) covers the quality of our installation and labour. As with all our work, it does not cover the equipment itself (which carries the manufacturer’s warranty, see section 8), fair wear and tear, or faults caused by a lack of routine servicing or misuse.
15. Emergency and after-hours work
We offer service seven days a week and can attend emergency and after-hours work. Emergency or after-hours work may be charged at higher rates than standard work. Where possible, we will quote the cost up front so you can approve it before we begin.
Finance is available (see section 16) so that cost does not have to be the reason you delay a safety fix. If you are dealing with a situation that is dangerous, such as sparking, burning smells or exposed live wiring, make the area safe, keep clear, and call us on 0418 645 757.
16. Finance options (Brighte and Zip)
We offer finance through third-party providers so you can spread the cost of larger work:
- Brighte (“fix now, pay later”); and
- Zip Pay.
These are third-party finance providers. Any finance is a separate arrangement between you and the provider, on the provider’s own terms, and is subject to their approval. We are not the credit provider and we do not give credit or financial advice.
Whether or not you use finance, you remain liable to us under these terms. Where a finance provider pays us directly for approved work, that payment is treated as payment by you for that work.
17. Cancellations
If you cancel
You can cancel work you have booked by letting us know as soon as possible. If you cancel after confirming the job, you may be charged for any costs we have actually incurred and for any work already completed, up to the time you cancel. The Deposit is dealt with as set out in section 4, so you only lose the part of it that matches what we have genuinely spent.
If we cancel
We may withdraw or cancel a Quote at any time before you accept it (see section 3). After work is booked, we may need to cancel or reschedule in limited situations, for example where the site is unsafe, where there is dishonesty toward or abuse of our staff, or because of an event outside our control (see section 19). If we cancel for one of those reasons, we will refund any amount you have paid for work we have not done and that does not relate to costs already incurred. If we cancel for any other reason, that is, other than for cause, we will refund you in full, including the Deposit.
Nothing in this section affects any cancellation right you have under the Australian Consumer Law.
18. Our liability
This section applies subject to section 9 and to the extent permitted by law. Nothing in this section excludes, restricts or modifies any consumer guarantee, right or remedy under the ACL that cannot lawfully be excluded.
Subject to your rights under the ACL, and to the extent the law permits us to do so:
- our liability to you for any claim connected with our work or these terms is limited as set out in section 9 (that is, at our option, to resupply or the cost of resupply for services, and to replacement, repair or the cost of the same for goods);
- we are not liable for loss or damage that was not reasonably foreseeable, or for loss that arises from your failure to tell us about a known hazard or service location, or from interference, alterations or repairs by anyone other than us; and
- we are not liable for indirect or consequential loss, such as loss of profit, loss of income or loss of business opportunity.
Where liability cannot lawfully be excluded but can be limited, our liability is limited in the way set out in section 9.
19. Events outside our control (force majeure)
We are not responsible for delays or failures caused by events outside our reasonable control. These include severe weather and storms, flood, fire, natural disaster, pandemic, strikes, failures or shortages in the supply of materials or equipment, faults or outages in the electricity network, and acts of government.
If an event like this affects the work, we will let you know and we will agree a new timeframe with you. Neither of us is liable to the other for a delay caused by an event of this kind, but this does not affect your obligation to pay for work we have already done.
20. Disputes and governing law (Queensland)
If something goes wrong, please contact us first on 0418 645 757 so we can try to put it right. Most issues can be sorted out quickly with a phone call.
These terms are governed by the laws of Queensland, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Queensland and the courts that hear appeals from them.
Nothing in this section stops you from making a complaint to a relevant regulator or from exercising any right you have under the Australian Consumer Law.
21. Privacy
We handle your personal information in line with our Privacy Policy, which you can read at /privacy-policy/. The Privacy Policy explains what we collect, how we use it, and how you can contact us about it.
22. Changes to these terms, and how to contact us
We may update these terms from time to time. The version that applies to your work is the one in force when you accept your Quote or engage us. The current version is always the one published on our website, with the “Last updated” date shown at the top.
